Why transactional emails are separate
Account, security, and operational emails are not marketing. Here is the line ChairNav draws.

Transactional emails are required to use the product safely — sign-in links, password resets, security notifications, billing receipts. They are not subject to marketing consent and cannot be unsubscribed from while the account is active.
Marketing, newsletters, and educational guides are entirely separate streams with their own opt-in.
